Waiver/Release/CC Authorization/Code of Conduct

RELEASE, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

In consideration of participating in AGRANI  New Jersey (AGRANI) activities, and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from negligence the AGRANI New Jersey (hereinafter referred to as AGRANI ) and its BOTs, Election Committee , members, volunteers, participants, and all other persons or entities acting for them (hereinafter collectively referred to as “Releasees”), on behalf of myself and my children, parents, heirs, assigns, personal representative and estate, and also agree as follows:

  1. I acknowledge that participating in AGRANI activities involves known and unanticipated risks which could result in physical or emotional injury, illness, paralysis or permanent disability, death, and property damage. Risks include, but are not limited to, broken bones, torn ligaments or other injuries as a result of falls or contact with other participants; death as a result of drowning or brain damage caused by near drowning in pools or other bodies of water; medical conditions resulting from physical activity or exposure to infectious diseases such as COVID-19; and damaged clothing or other property. I understand such risks simply cannot be eliminated, despite the use of safety equipment and increased cleaning, sanitation and physical distancing, without jeopardizing the essential qualities of the activity.
  2. I expressly accept and assume all of the risks inherent in this activity or that might have been caused by the negligence of the Releasees. My/My child’s participation in these activities is purely voluntary and we elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that I or my child are unable to participate due to physical or medical conditions, then I will immediately discontinue participation.
  3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releasees from any and all claims, demands, or causes of action which are in any way connected with my/my child’s participation in these activities, or our use of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intentional conduct or conduct that constitutes greater than ordinary negligence. Should Releasees or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
  4. I represent that I have adequate insurance to cover any injury or damage I or my child may suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I/my child have no medical or physical conditions which could interfere with our safety in these activities, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition.
  5. In the event that I file a lawsuit, I agree to do so in the state where Releasees’ facility is located, and I further agree that the substantive law of that state shall apply.

I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

Parent/Guardian Authorization – Transportation/Medical

  1. In the event that I/my child need immediate medical attention for injuries or illness that may occur while participating in an AGRANI program, I authorize the AGRANI staff to give me or my child reasonable first aid, and to arrange transport of myself or my child to a health care facility for emergency services as needed.  I understand that I may be asked to isolate myself or my family and may be asked to leave a program early if I display symptoms of illness such as COVID-19.
  2. I hereby acknowledge that the AGRANI will assume that either parent of the child may pick up the child at any time during the program unless there is pertinent court documentation on file at the AGRANI that indicates otherwise.
  3. I agree to the release of any records necessary for treatment, referral, billing, infectious disease tracking, or insurance purposes. The AGRANI receives medical information on campers/participants that may need to be shared with medical providers, insurance carriers, or other governmental agencies as required.
  4. If I or my child requires use and administration of an epi-pen, prescription or over the counter medication, it is my responsibility to ensure that the epi-pen and/or medication are on me or my child or within our personal belongings every day of the program. If AGRANI member is required to administer and use the epi-pen and/or medication, I agree to forever release and discharge the AGRANI and its directors, officers, and employees from any and all liability arising out of or resulting from use or administration of the epi-pen and/or medication.

General 

  1. I hereby release all pictures and video of myself or my child taken by the AGRANI for promotional purposes and programming materials including the AGRANI website.
  2. I acknowledge that certain sections of this waiver may not apply to me and/or my child and the programs or activities that we have chosen but agree to be bound by any applicable language.

I agree that if I or my child is hurt or our property is damaged during participation in these activities, then I or my child may be found by a court of law to have waived our right to maintain a lawsuit against the parties being released on the basis of any claim for negligence.

I have had sufficient time to read this entire document / web page and, should I choose to do so, consult with legal counsel prior to signing. Also, I understand that this activity might not be made available to me or that the cost to engage in this activity would be significantly greater if the AGRANI did not utilize waivers as a method to lower insurance and administrative costs. I have read and understood this document and I agree to be bound by its terms.

PARENT OR GUARDIAN ADDITIONAL AGREEMENT
(For participants under the age of 18)

In consideration of being permitted to participate in AGRANI activities, I further agree to indemnify and hold harmless Releasees from any claims alleging negligence which are brought by or on behalf of minor or are in any way connected with such participation by minor.

Credit Card Authorization/Payment Terms

Program /Merchandise cost you see in our Shopping Cart reflects current pricing, including discounts if registering during a promotional period.

Payment for Services. AGRANI cannot guarantee the safety of financial information since it’s been outsourced to third parties like PayPal etc. (referred as “Service”).

By submitting payments through the Service, you authorize AGRANI to process your payments according to your instructions. You are responsible for any legal, regulatory, or banking penalties and fees that may be assessed for supplying false information to us for use with the Service. You may use the Service only to authorize the payment of event costs owing to AGRANI and its affiliates. Payments that you authorize will be made from a bank or financial institution account (the “Transaction Account”) that you designate. It is your responsibility to establish and maintain the Transaction Account and to pay any and all fees associated with the Transaction Account. By accepting these Terms and Conditions, you represent and warrant to AGRANI that: (i) you are 18 years old or older; (ii) you are using your actual identity and any information you provide is accurate and complete; (iii ) you are legally authorized to make payments using the Transaction Account; and (iv) your use of the Service will not violate any local, state, national or international laws or regulations.

Timing. By providing AGRANI with a payment authorization under the Service, you authorize AGRANI to charge the Transaction Account to remit funds on your behalf to pay for AGRANI events/programs/membership or merchandise. It is your responsibility to make timely payment authorizations, so that the funds will arrive at AGRANI before the date on which they are due. You should submit all payment authorizations to AGRANI at least three (3) business days before the actual due date for the event registration. A “business day” means any day other than Saturday, Sunday, a federal holiday, or any other day on which banks in the United States are not generally open for business. You shall bear the risk and the responsibility for paying any late charges or penalties resulting from the late receipt of any payment made under the Service.

Our Responsibilities. AGRANI will use all reasonable efforts to process all your payment authorizations promptly and properly, provided the authorizations are actually received by AGRANI. AGRANI will not be responsible for any failure to process a payment authorization that is not actually and completely received by AGRANI for any reason, including user error, equipment malfunction, natural disasters or impediments, or inaccurate or incomplete information.

If AGRANI does not process a payment made by you in the correct amount, AGRANI will be liable for your losses. However, AGRANI shall not be responsible and shall not be liable for any of your losses if it is unable to complete a payment authorization initiated by you because of the existence of any one or more of the following circumstances:

The Transaction Account does not contain sufficient funds to complete the transaction, or the transaction would exceed the credit limit applicable to the Transaction Account.

You have not provided AGRANI with correct names or account information.

Circumstances beyond AGRANI’s control (such as, but not limited to, fire, flood, internet service interruptions, or interference from an outside force) prevent the proper transmission of your payment authorization.

AGRANI fails to receive a full and complete payment authorization.

You have made any false or materially misleading statement or representation in connection with any payment authorization.

The bank or financial institution maintaining the Transaction Account refuses or is unable to honor a payment request.

Banking Limitations. In using the Service, you are requesting AGRANI to take payments for you from your designated Transaction Account. If your bank or financial institution is unable to process a transaction (for example, there are not sufficient funds in the Transaction Account to cover the transaction, or if funds in the account are unavailable for any reason), the transaction may not be completed. There may be limits or restrictions upon the number or frequency of payments that may be made from your Transaction Account under applicable law or under the terms of your agreement with the bank or financial institution maintaining the Transaction Account. AGRANI’s obligations under the Service are subject to any such limits or restrictions, and AGRANI has no duty to notify you of any such limits or restrictions.

All payments are non-refundable. Part payments benefits cannot be availed unless fully paid. Check bounce fees will be charged to the party based on fees charged to AGRANI.

AGRANI will not be responsible for loss of letters or checks in mail.

AGRANI Member, Participant, and Guest Code of Conduct – all programs and activities

Our membership code of conduct embodies the spirit of the AGRANI, and is intended to help everyone including members, participants, and guests feel welcome and safe at the AGRANI .

As a member, participant or guest, you agree to follow our code of conduct which is rooted in the values of caring, honesty, respect, responsibility and equity.  That’s why the following personal conduct is prohibited in all AGRANI rented facilities, programs and events:

  1. Inappropriate attire. Appropriate attire must be worn at all times. No clothing with vulgar language, obscene gestures, racial slurs, or anything that contributes to a hostile environment or would be considered inappropriate in a family facility.
  2. Inappropriate language. Hostile or vulgar language, including swearing, name-calling or shouting.
  3. Threatening physical contact. Physical contact with another person in any hostile or threatening way including but not limited to “play fighting”.
  4. Sexual activity. Any demonstration of sexual activity or sexual contact with another person.
  5. Harassment / intimidation. Harassment or intimidation by words, gestures, body language or any menacing behavior that demeans another person or culture.
  6. Theft / destruction of property. Theft or behavior that results in the destruction of property.
  7. Weapons. Carrying or concealing any weapons or devices or objects that may be used as weapons (including items that appear to be real).  The AGRANI bans all weapons on premises with or without a permit.
  8. Illegal chemicals or alcohol. Using or possessing alcohol or drugs on AGRANI property, in AGRANI vehicles, or at AGRANI sponsored programs.
  9. Inappropriate conduct. Any other conduct of an inappropriate, threatening or offensive nature.
  10. Loitering. Loitering is not permitted in or outside AGRANI rented facilities or programs.
  11. Inappropriate cell phone activity. Cell phone or photographic/video equipment use of any kind – organizing playlists, music, texting, camera functions, video recording – is not permitted at any time.  Phone calls are not allowed during the events.
  12. Tobacco. The use of tobacco or tobacco-like products, including e-cigarettes, are not permitted inside AGRANI facilities or programs
  13. Social Media. Use of social networking websites in a manner that is contrary to the AGRANI ’s mission, is detrimental to the community or is in violation of the law.
  14. Non payment of membership fees

If a member, participant or guest feels uncomfortable in confronting someone directly about offensive behavior or other issues that are in violation of the code of conduct they should report the behavior to an AGRANI’s Board Of Trustees member.

Suspension or termination of AGRANI membership may result from a violation of this Code of Conduct. While an incident is being investigated, the membership of the person(s) accused of violating this Code of Conduct may be temporarily suspended pending a final decision.

To create and maintain a space that embodies our core values, the AGRANI is serious about being clear regarding activities that are not allowed. If you or your invited guests violate this code of conduct, consequences can include termination of membership or program privileges. The AGRANI reserves the right to make situational decisions based on its mission and values.

Terms and conditions of the Association defined programs are subject to change. I agree to abide by the current policies and procedures and the code of conduct, and agree to abide by the rules and policies of the AGRANI, including any future changes approved by the governing bodies in accordance with its Charter and Bylaws.
